The City of Lorain Community Development Block Grant Program (CDBG) and HOME Investment Partnership Program (HOME)

 

TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: On or about October 19, 2019 the above named City will request the U.S. Department of Housing and Urban Development (HUD) to release Federal funds under Title I of the Housing and Community Development Act of 1974, for the following programs and projects for PY 2019.

The City of Lorain has made a determination that the above projects will have no significant impact on the environment. Therefore, environmental impact statements under the National Environmental Policy Act of 1969 are not required. Additional information on these projects is contained in the environmental review records on file at the City of Lorain Building, Housing, & Planning Development (BHP) ; 200 West Erie Avenue, 5th Floor, Lorain, OH 44052. Any individual, group or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the City of Lorain Building, Housing, and Planning Department at the address above. All comments received by October 19, 2019 will be considered by the City of Lorain prior to authorizing submission of a request for release of funds. Commentators should specify which part of this notice they are addressing.

The City of Lorain will undertake the project(s) described above with CDBG funds from the U.S. Department of Housing and Urban Development (HUD), under Title I of the Housing and Community Development Act of 1974 and the HOME Investment Partnership Program. The City of Lorain is certifying to HUD that the City and Mayor Joseph F. Koziura, in his official capacity as Mayor of City of Lorain, consent to accept the jurisdiction to the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the City of Lorain may use the Community Development Block Grant funds, HOME funds, etc. and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969.

HUD will consider objections to its approval of the release of funds and acceptance of the certification only if it is on one of the following bases: (a) the certification was not executed by the chief executive officer or other officer of applicant approved by HUD; or (b) that applicant's environmental review record for the project(s) indicated omission of a required decision, finding, or step applicable to the project in the environmental review process; (c) the grant recipient or other participants in the project(s) have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58), and may be addressed to HUD at 200 North High Street, Columbus, Ohio 43215. Objections to the release of funds on basis other than those stated above will not be considered by HUD. HUD will consider objections received by November 5, 2019 or a period of fifteen days from its receipt of the request, whichever is later.
